How does Hyundai get around this? As I said, I have not seen any documentation on limiting the exhaust settings when using the car on public roads.

I hardly ever use the car in N-mode. In Belgium the roads are so bad, pretty much everybody has the N-custom mode on soft dampers.
It would be impossible to drive on N all day. I use normal most of the time and N-custom when the road allows it (not in a village at 6 am)
